1. General Information and Acceptance
These Terms and Conditions (the "Terms") govern access, browsing, and use of the website www.iberiaintel.com (the "Website"), as well as the services, interactive tools, demonstration platforms, and content offered through it (collectively, the "Services"), owned by:

Accessing the Website grants the status of User and implies full and unreserved acceptance of these Terms, as well as the Privacy Policy and Cookie Policy published on the Website. If you do not agree with any provision, you must refrain from using the Website and the Services.
2. Purpose and Description of Services
IberiaIntel is a company specialized in providing professional digital transformation services, including without limitation:
- Design, development, and deployment of AI agents and automations for business operations.
- Cyber intelligence services (ArgesAI and ErisAI platforms) for protecting, monitoring, and analyzing digital assets.
- Digital marketing services including AI-enhanced SEO, local and international SEO, automated content generation, keyword research, and SEO-oriented website infrastructure maintenance and optimization.
- Interactive demonstration platforms (conversation simulators, flows, and use cases) for purely educational and commercial purposes.
- Consulting, training, and maintenance services related to the above.
The description, scope, and economic conditions of each specific service shall be formalized, where applicable, through a separate contract or specific commercial proposal that shall prevail over these Terms regarding the specific service delivery.
3. Access and Use Conditions
3.1. Free access
Access to and browsing of the Website are generally free of charge. However, the use of certain Services may be conditional on the prior conclusion of a contract and payment of the agreed price, under the terms expressly indicated.
3.2. Legal capacity
To use the Services, the User declares to be of legal age and to have sufficient legal and contractual capacity to accept the Terms. If acting on behalf of a legal entity, the User declares to have the necessary representation or authorization to bind it.
3.3. Compliant use
The User agrees to use the Website and Services in accordance with the law, morality, public order, and these Terms, refraining from:
- Using the Services for illicit purposes, harmful to third-party rights, or contrary to public order.
- Introducing, storing, or distributing computer viruses, malicious code, or any other content that may damage IberiaIntel's or third-party systems.
- Performing scraping, data mining, reverse engineering, decompilation, disassembly, or any similar technique aimed at extracting, reproducing, or emulating the Website's infrastructure, platforms, or underlying models.
- Using forms, simulators, or APIs with automated means (bots, scripts) that generate an anomalous load or compromise service availability.
- Attempting to evade, disable, or breach the Website's security measures.
- Reproducing, copying, distributing, publicly communicating, transforming, or modifying Website content without express written authorization from IberiaIntel.
Non-compliance with these obligations entitles IberiaIntel to interrupt or deny User access and to take any legal actions deemed appropriate.
4. Demo Platforms (Simulators)
The interactive platforms and environments published on the Website (including, without limitation, the ArgesAI, ErisAI simulators, and Automation flows) are strictly demonstrative, educational, and commercial. By their very nature:
- The displayed data is synthetic or fictitious, generated for demonstration purposes.
- No real operations are performed, no data is shared with third parties, and no legal effects arise from interaction with the simulators.
- Any stochastic coincidence between simulated data and real natural or legal persons is purely coincidental and not attributable to IberiaIntel.
- IberiaIntel does not guarantee the continued availability of the simulators, which may be modified or withdrawn without prior notice.
The User agrees not to enter real personal, confidential, or sensitive data into demo environments. Information provided in simulators is not stored in persistent databases, not used to train AI models or feed real analytics, and will be purged immediately.
5. Professional Service Contracts
5.1. Proposals and contracts
The effective contracting of any IberiaIntel professional service (consulting, implementation, SEO, maintenance, development, cyber intelligence, etc.) shall be done by signing a commercial proposal, accepted quote, or separate contract, detailing scope, deliverables, deadlines, price, and applicable payment terms.
5.2. Prices and taxes
Prices are expressed, unless otherwise indicated, in Euros (€) and do not include applicable taxes or fees (VAT or others), which will be charged to the User in accordance with current legislation.
5.3. Invoicing and payment
IberiaIntel will issue corresponding invoices as agreed. Payments will be made through enabled means (bank transfer, card, or other means accepted by the Company). Online payment processing is performed through external providers such as Stripe or PayPal, subject to their own terms.
5.4. Right of withdrawal
When the User is a consumer within the meaning of the Spanish Consolidated Text of the General Law for the Defense of Consumers and Users, they shall have 14 calendar days to withdraw from the contract without need for justification, except in legally exempted cases (e.g., services already performed with prior consent, or personalized digital content).
5.5. Guarantee of results in SEO services
Organic positioning (SEO) and digital marketing services aim to improve client visibility in search engines, but IberiaIntel cannot guarantee a specific result in terms of rankings, traffic, or conversions, as these depend on external factors (third-party algorithms, competition, market behavior). IberiaIntel is only obligated to apply diligent means and good professional practices.
6. Intellectual and Industrial Property
All Website and Service content — including without limitation source code, graphic designs, the "IberiaIntel" brand, logos, the ArgesAI and ErisAI names, automation agent architectures, texts, images, videos, databases, and AI models — is the exclusive property of IberiaIntel or third parties that have granted the corresponding license, and is protected by national and international intellectual and industrial property regulations.
Use of the Website or Services does not imply the assignment or licensing of these elements to the User, who must refrain from copying, reproducing, distributing, transforming, or commercially exploiting them, except with express written authorization from the owner.
Regarding deliverables developed within a specific service, ownership and assignment conditions shall be regulated in the specific contract signed between the parties.
7. Exclusions and Limitation of Liability
IberiaIntel will strive to keep the Website and Services operational, updated, and error-free, but does not guarantee the absence of interruptions, delays, errors, omissions, data loss, or viruses when due to causes not attributable to the Company.
In particular, IberiaIntel will not be liable for:
- Third-party information, content, or services accessible from the Website.
- Damages arising from improper use of the Website or Services by the User.
- Damages from cyberattacks, third-party provider outages (hosting, payment gateways, AI model providers, etc.) or force majeure incidents.
- Business decisions made by the User based on Website or simulator informational content, which is merely illustrative.
In any case, and except where law prevents limitation of liability, IberiaIntel's total liability to the User for any reason will be limited to the amount actually paid by the User in the twelve (12) months preceding the event giving rise to the claim.
8. Links to Third-Party Sites
The Website may contain links to web pages managed by third parties. Such links are offered for informational purposes only and do not imply recommendation, assumption of responsibility, or any relationship between IberiaIntel and the owners of linked sites. IberiaIntel does not control or supervise such sites and is not responsible for their content, policies, or practices.
9. Personal Data Protection
The processing of personal data provided by the User through the Website or in connection with contracting the Services shall be governed by the Privacy Policy and Cookie Policy, which form an integral part of these Terms and are drafted in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
10. Force Majeure
Neither party shall be liable for breach of obligations due to force majeure or fortuitous events, including without limitation: natural disasters, armed conflicts, terrorist acts, pandemics, strikes, widespread failures of telecommunications networks or cloud services, or decisions by competent authorities that prevent service delivery.
11. Terms Modifications
IberiaIntel reserves the right to modify, at any time and without prior notice, the presentation, configuration, and content of the Website, as well as these Terms. Modifications will be effective from the moment of publication on the Website. The User is recommended to periodically review this page to know the current version.
12. Partial Nullity
If any clause of these Terms is declared totally or partially null or ineffective by final judicial or administrative resolution, such nullity will not affect the validity of the other clauses, which will fully retain their effectiveness. The affected clause will be replaced by another that, being lawful, pursues the same objectives as the original.
13. Applicable Law and Jurisdiction
These Terms are governed by Spanish law. For resolving any dispute arising from their interpretation, compliance, or execution, the parties submit, with express waiver of any other applicable jurisdiction, to the Courts and Tribunals of IberiaIntel's registered office, unless mandatory applicable regulations impose another jurisdiction when the User is a consumer.
Pursuant to Regulation (EU) 524/2013, the consumer User is informed of the existence of a European online dispute resolution platform accessible at ec.europa.eu/consumers/odr.
